Legal name vs trading name

  • Legal name is the name on formation or registration paperwork. It may need a required suffix such as LLC, Ltd, GmbH, SARL, Pty Ltd, sp. z o.o. or another local form.
  • Trading name / DBA / assumed name is the public name you trade under. It can let one legal entity run several brands, but many countries still require registration or disclosure.
  • Trademark protects the brand for specific goods and services. A company-name registration does not automatically give trademark rights; that is a separate search and filing.

Clearance checklist

  1. Company or business register: check the official register in your country or state for identical and confusingly similar legal names.
  2. Trademark: search the relevant national office, EUIPO/TMview where applicable, and WIPO’s Global Brand Database if you plan to trade internationally.
  3. Domain: look for the best local and global domains before announcing the name. A matching .com is useful, but country-code domains can be stronger in local markets.
  4. Social handles: check Instagram, TikTok, LinkedIn, YouTube and X/Twitter together so the brand is consistent.
  5. Search engines and marketplaces: search the name with your industry and location. Existing use in the same category is a warning sign even if the exact legal name is free.
